NCAA Passes Interim Name, Image And Likeness Policy, Ushering In New Possibilities For Student Athletes

The governing bodies of all three NCAA divisions passed a uniform interim name, image and likeness policy today following last week’s loss at the Supreme Court. Although the case didn’t directly impact NIL, it did appear to change the NCAA’s strategy for adopting NIL legislation. This interim policy will govern NIL until there’s either federal legislation or new NCAA rules.

The interim policy provides the following guidance:

A set of frequently asked questions provides further clarity on several issues:

Schools will also be able to adopt their own rules consistent with these guidelines. Several schools have done so already, including University of Alabama, University of Florida, Florida State and University of Louisville.

Ten states have NIL laws that go into effect July 1, including Alabama, Florida, Georgia, Illinois, Kentucky, Mississippi, New Mexico, Ohio, Oregon and Texas. Oklahoma and Nebraska passed laws that allowed schools to grant rights immediately, although no schools announced a grant of rights prior to July 1.

Pennsylvania included an article granting NIL rights in its budget today, which allowed the law to go into effect immediately. However, the NCAA’s FAQ released today makes it clear deals are not permitted until tomorrow.

That hasn’t stopped student athletes and brands from announcing deals, however.

Clothing brand Onward Reserve announced in early June it would be working with University of Georgia student athletes Brock Vandagriff, Matthew Boling, Jack Podlesney, Trent Phillips, and Connor Tate who play on the school’s football, baseball and golf teams.

Atlanta-based Milner Technologies has said it will offer endorsement deals worth a combined $10,000 to Miami (FL) volleyball student-athlete Burrell, Florida gymnast Thomas, Florida State soccer player Howell and UCF hurdler Jones.

Runza, a regional food chain, announced today a plan to work with 100 student athletes in the state of Nebraska at a flat rate to promote the brand’s rewards app on their social channels.

Iowa men’s basketball student athletes Jordan Bohannon will be signing autographs at a fireworks stand in Windsor Heights, Iowa tomorrow.

He also previously announced his own apparel line.

Other student athletes are preparing by registering their trademarks and snagging URLs with their names.

If my own inbox is any indication, prepare for the flood gates to open tomorrow as brands and student athletes beginning announcing the first slew of deals.
