The brother of accused Sydney drug lord Mostafa Baluch was on bail over an alleged violent attack in Sydney's Kings Cross area when he was reportedly shot in the legs in broad daylight on Thursday.

Imran Baluch, 26, the younger brother of alleged drug importer Mostafa who was once Australia's most wanted man before his dramatic 2022 arrest, allegedly assaulted another man in the early hours of New Year's day.

Mr Baluch had just had his police bail reporting conditions on the affray charge varied when he presented at hospital with gunshot wounds to his legs just before noon on Thursday.

Court documents  seen by Daily Mail Australia reveal that Mr Baluch, who has a criminal history including drug and knife offences, was arrested on January 1 just after 2am following an allegedly violent encounter with another man at Potts Point.

The man had cause to fear for his personal safety, police claim.

On Monday this week, Imran Baluch applied to have his daily police reporting bail conditions eased to weekly reporting at a western Sydney police station a short drive from his home.

But shortly after 11.35am on Thursday, he presented himself with gunshot wounds to his legs at Westmead Hospital where he remains in a stable condition and police say that detectives are yet conduct a formal interview with him.

Officers from the State Crime Command’s Raptor and Criminal Groups Squads are investigating the circumstances of the shooting and who fired the shots into Mr Baluch.

Imran Baluch has a history of offences including being in custody of a knife in a public place, in 2021 and in 2020, possessing a prohibited drug in 2018 and 2017, as well as traffic offences, incurring $4500 in fines.  

He and his brother Mostafa, who sparked one of Australia's biggest police searches last year, are from a well-known Sydney family of restaurateurs who migrated from Afghanistan. 

Police allege Mostafa was involved in an organised crime syndicate that conspired to import and distribute three tonnes of cocaine, potentially worth an estimated $900 million.

With help from US authorities, 1770 kilograms of cocaine was seized from two vessels off the coast of Colombia in October 2020 and Ecuador in April 2021. 

Police allege Mostafa was the sole financier of the second shipment of cocaine, about 900kg which had an estimated street value in Australia of at least $270million.

His high-profile arrest was the culmination of a weeks-long search after he allegedly cut off an ankle monitor on a golf course behind his luxury Bayview home and went on the run in a Range Rover.

He was allegedly found hiding in the back of a luxury Mercedes inside a shipping container on the back of a truck at the Queensland-NSW border in November.

Five men have been charged so far over their alleged involvement in the syndicate. 

His brother is not involved in the alleged importation or charged with any offence. 

There is no suggestion of wrongdoing against any other family members. 

2020: Mostafa Baluch was arrested as part of an investigation into an alleged organised crime sting plotting to supply three tonnes of cocaine in NSW. Detectives started the investigation after receiving a tip about a person gambling a huge amount of money at the Star Casino. The betting was flagged as potential money laundering and kicked off an investigation that eventually became focused on drug trafficking.

June 2021: Charged with drug offences when his Bayview home on Sydney's northern beaches was raided

October 22, 2021: He was granted bail on several conditions and was forced to wear an ankle monitor

October 25, 2021: The tracking device stopped working and police began urgently trying to locate the fugitive

October 26, 2021: Baluch was due to front court but didn't arrive. Police believe they spotted Baluch in the backseat of a black Range Rover as it travelled east on the M4 at Croydon.

November 4: Police raid homes in Potts Hill and Yagoona in Sydney's south-west in their manhunt for Baluch. They seized more than $250,000 cash, about 200 grams of cocaine, 485 grams of an unknown substance, mobile phones, and an electronic money counter

November 5: Organised Crime Squad Commander Detective Superintendent Rob Crichlow gave an update saying they believed he was still in NSW.

November 10: Baluch is captured by police on the NSW/Queensland border when police intercepted a truck. Baluch was found in the boot of a Mercedes SUV in a shipping container on the back of the truck.
